The Background

On December 18, 2024, Mayor Mike Johnston signed Ordinance 24-1765, banning the retail sale of most flavored tobacco and nicotine products in Denver. Enforcement is scheduled to begin January 1, 2026. In January 2025, a coalition led by a Denver vape shop owner filed a petition to refer the ordinance to voters. Petitions were approved for circulation and later submitted. After over 12,000 were collected, the clerk’s office has since certified that Referendum 310 will be placed on the November 2025 ballot.

Referendum 310 asks voters whether they wish to retain Ordinance 24 1765, prohibiting the sale of flavored tobacco products.

  • Yes = Keep the ban in place.

  • No = Repeal the ban to Protect Local Stores and Business.

Why It Matters

Standing with Small Businesses

Local franchisees and shop owners, many of whom are immigrants and first-time entrepreneurs, will be hit hardest by this ban. Similar restrictions elsewhere led to decreased sales, job layoffs, and store closures. A “No” vote protects Denver’s neighborhood stores and the jobs they provide.

Keeping Business in Denver

Denver could lose at least $15 million each year in tax revenue if the ban stays in place, money that would flow to surrounding cities instead. That's critical funding for schools, roads, and public safety – money that Denver can’t afford to lose. A “No” vote keeps those dollars in our community.

Protecting Consumer Choice

Adults deserve the freedom to make legal choices without unnecessary bans. Denver already has tough safeguards in place to keep these products out of the hands of kids. Voting “No” ensures responsible adults keep the right to choose while remaining committed to protecting our youth.

  • Visit the Denver Elections Division website to register or update your information.

Watch for Your Ballot

  • Ballots will be mailed beginning October 10.

Return Your Ballot Early

  • The sooner, the better – so your vote is counted without delay.

Key Deadlines to Remember

  • The online or mail registration deadline is Monday, October 27.

  • In person registration is allowed through Election Day, Tuesday, November 4.
